UNPAID OVERTIME FOR TRUCK DRIVERS
Congress recently passed an amendment to a Federal law that may entitle certain transporation employees to overtime wages if they drive motor vehicles weighing 10,000 lbs or less.
Most transportation companies rely on an obscure federal law (known as the Motor Carrier Act) to avoid paying many of their employees overtime under the Fair Labor Standards Act.
Employees of motor carriers are generally governed by the Detpartment of Transportation, which has authority to establish maximum hours of service. It is this law that allows many truck drivers to be paid "by the mile" or "by the load" without extra pay for hours worked over forty in a workweek.
This will still be true for many "big rig" truckers. However, for employees who transport goods or provide services in vehicle weighing less than 10,000 pounds, Congress has changed the law such that those employees are not governed by the Department of Transporation's authority.
Instead, it is the Department of Labor who has authority over how those employees must be paid. This means that such employees are probably entitled to be paid time-and-one-half for hours worked over 40, regardless of whether the employee is paid a salary, hourly, by the load, by the mile, or using any other method of payment.
